Terms of Service

By accessing or using Quitarfondo.co ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Description of Service

Quitarfondo.co provides an automated, AI-powered image background removal tool. The Service processes images using third-party AI models and returns the result to the user. The Service is provided free of charge and without requiring user registration.

2. Acceptable Use

You agree not to upload, submit, or use the Service to process any content that:

Depicts, involves, or exploits minors in any way, including but not limited to child sexual abuse material (CSAM);
Contains non-consensual intimate imagery or deepfake pornography;
Is sexually explicit, obscene, or pornographic;
Promotes violence, terrorism, self-harm, or harm to others;
Is harassing, threatening, defamatory, or discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;
Infringes upon the intellectual property, privacy, or publicity rights of any third party;
Is fraudulent, deceptive, or intended to mislead (including deepfakes for disinformation);
Violates any applicable local, state, national, or international law or regulation; or
Attempts to compromise, disrupt, or reverse-engineer the Service or its infrastructure.

Zero-tolerance policy: We maintain an absolute zero-tolerance policy for CSAM and any content that exploits minors. Any suspected violations will be immediately reported to the National Center for Missing & Exploited Children (NCMEC), the Internet Watch Foundation (IWF), and/or applicable law enforcement authorities, along with all available identifying information (IP address, timestamps, and content hashes).

3. Content Responsibility

You are solely responsible for the content you upload to the Service. By using the Service, you represent and warrant that:

You own or have all necessary rights, licenses, and permissions to use and process the uploaded content;
Your content does not violate these Terms or any applicable law; and
You accept full responsibility for any consequences arising from uploading or processing your content.

We do not claim ownership of any content you upload. We do not review, monitor, or moderate uploaded content before processing. However, we reserve the right to implement content moderation measures at any time.

4. Content Moderation

We reserve the right, but are not obligated, to:

Implement automated or manual content moderation tools;
Refuse to process any content at our sole discretion;
Block or restrict access to users who violate these Terms;
Report illegal content and associated user data to law enforcement authorities; and
Cooperate fully with any law enforcement investigation.

5. Third-Party Processing

Images uploaded to the Service are processed by third-party AI services (currently fal.ai). By using the Service, you acknowledge and agree that your content will be transmitted to and processed by these third-party providers, subject to their respective terms of service and privacy policies. We are not responsible for the data handling practices of third-party processors.

6. Intellectual Property

The Service, its design, code, and branding are the property of Quitarfondo.co. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR DO WE GUARANTEE THE ACCURACY OR QUALITY OF ANY PROCESSING RESULTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUITARFONDO.CO AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED USD $50.00.

9. Indemnification

You agree to indemnify, defend, and hold harmless Quitarfondo.co and its operators, affiliates, officers, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any applicable law; or (iv) any content you upload to the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, all provisions of these Terms which by their nature should survive shall remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Medellín, Colombia.

12. Changes to These Terms

We may modify these Terms at any time by posting the revised version on this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
